1. Introduction

These Terms and Conditions govern the use of the Real Estate Post-Training Support Platform available at https://www.realestatelearnership.co.za/.

The platform is an online learner placement portal designed to support post-training placement, internships, workplace exposure, practical training and entry-level employment opportunities within the real estate sector.

By accessing, registering on, or using the platform, users agree to be bound by these Terms and Conditions.

2. Definitions

In these Terms and Conditions:

“Platform” means the Real Estate Post-Training Support Platform available at https://www.realestatelearnership.co.za/.

“Learner” means a person who registers on the platform to create a profile, upload documents, search for opportunities and apply for placements or jobs.

“Employer” means a real estate agency, firm, business, organisation or authorised representative that registers on the platform to post opportunities or review learner applications.

“Administrator” means a person authorised by the platform owner to manage users, content, opportunities, applications and reports.

“Opportunity” means any placement, internship, learnership, workplace exposure opportunity, practical training opportunity, entry-level position, vacancy or related real estate sector opportunity posted on the platform.

“User” means any learner, employer, administrator or visitor who accesses or uses the platform.

“Personal Information” has the meaning given to it under applicable South African data protection laws, including POPIA.

3. Purpose of the Platform

The purpose of the platform is to:

  1. Support post-training placement of real estate learners.
  2. Enable learners to register and apply for relevant opportunities.
  3. Enable employers to post real estate sector opportunities.
  4. Assist administrators to monitor registrations, applications and placements.
  5. Provide a central online platform for learner placement support.

The platform does not guarantee that any learner will be placed, employed, shortlisted or selected for any opportunity.

4. Eligibility to Use the Platform

Users may use the platform only if they are legally permitted to do so and can provide accurate and lawful information.

Learners may be required to provide personal, educational and professional information, including supporting documents.

Employers must be authorised to act on behalf of the company, agency or organisation they register.

The platform owner may reject, suspend or remove any user account where information is false, misleading, inappropriate, unlawful, incomplete or in breach of these Terms.

5. User Registration

Users may be required to register an account before accessing certain functions.

Users agree to:

  1. Provide accurate and complete information.
  2. Keep login details confidential.
  3. Update account information when it changes.
  4. Not allow unauthorised persons to use their account.
  5. Notify the platform administrator of suspected unauthorised access.

The platform owner is not responsible for loss or damage arising from a user’s failure to protect login credentials.

6. Learner Responsibilities

Learners agree that:

  1. All information submitted must be true, accurate and complete.
  2. Uploaded documents must belong to the learner or be lawfully submitted.
  3. CVs, qualifications, certificates and supporting documents must not be falsified.
  4. Applications must be submitted honestly and in good faith.
  5. Learners must not misuse employer contact information.
  6. Learners must not submit offensive, unlawful, discriminatory or misleading content.
  7. Learners are responsible for attending interviews, responding to employers and following application instructions.

The platform owner may remove learner profiles or documents that are inaccurate, inappropriate or unlawful.

7. Employer Responsibilities

Employers agree that:

  1. They are authorised to post opportunities on behalf of their organisation.
  2. All opportunities posted must be genuine, lawful and related to legitimate work, placement, internship or training opportunities.
  3. Opportunity descriptions must be accurate and not misleading.
  4. Employers must not charge learners any unlawful placement, recruitment or application fees.
  5. Employers must treat learner information confidentially.
  6. Employers must comply with applicable labour, employment, privacy and anti-discrimination laws.
  7. Employers must not post fraudulent, exploitative, abusive or inappropriate opportunities.
  8. Employers must not use learner information for unrelated marketing, resale, spam or unauthorised purposes.

The platform owner reserves the right to review, edit, reject, suspend or remove any employer account or opportunity.

8. Opportunity Listings

The platform may allow employers or administrators to create, edit, close or remove opportunity listings.

The platform owner does not guarantee:

  1. The accuracy of every opportunity posted by employers.
  2. That every opportunity will remain available.
  3. That learners will be shortlisted or selected.
  4. That employers will respond to every application.
  5. That a placement or employment relationship will result from any application.

Users are encouraged to verify information before relying on any opportunity listing.

9. Applications and Selection Process

Learners may apply for opportunities through the platform.

Employers are responsible for reviewing applications, shortlisting candidates, contacting learners and managing any interview or selection process.

The platform owner is not the employer, recruiter or labour broker unless expressly stated in writing.

The final decision to shortlist, interview, place or appoint a learner rests with the relevant employer.

10. No Guarantee of Employment or Placement

The platform is a facilitation tool only.

Registration on the platform does not guarantee:

  1. Employment.
  2. Internship placement.
  3. Workplace exposure.
  4. Practical training placement.
  5. Shortlisting.
  6. Interview invitations.
  7. Income or remuneration.
  8. Any specific outcome.

Learners remain responsible for actively applying, maintaining updated profiles and responding to employer communication.

11. User Content

Users may submit information, documents, profiles, job listings, application materials and other content.

Users confirm that they have the right to submit such content and that the content does not infringe any law, contract, confidentiality obligation or third-party right.

The platform owner may remove or restrict content that is:

  1. False or misleading.
  2. Offensive or discriminatory.
  3. Unlawful.
  4. Fraudulent.
  5. Spam or promotional abuse.
  6. In breach of these Terms.

12. Prohibited Use

Users may not use the platform to:

  1. Commit fraud or misrepresentation.
  2. Upload false documents.
  3. Post fake opportunities.
  4. Harass, threaten or abuse other users.
  5. Collect user data without permission.
  6. Send spam or unsolicited marketing.
  7. Upload viruses, malware or harmful code.
  8. Attempt to hack, disrupt or overload the platform.
  9. Circumvent security or access controls.
  10. Use the platform for unlawful, discriminatory or exploitative purposes.

The platform owner may suspend or terminate access where prohibited conduct is suspected.

13. Verification and Moderation

The platform owner may, but is not obliged to, verify user information, employer profiles, learner profiles, documents or opportunity listings.

Approval of any account, profile or opportunity does not constitute an endorsement, guarantee or certification by the platform owner.

Users remain responsible for conducting their own checks before entering into any arrangement.

14. Privacy and Personal Information

The platform processes personal information including learner profiles, contact details, CVs, qualifications, certificates, employer details and application records.

Personal information will be processed for purposes including:

  1. Account registration.
  2. Learner profile management.
  3. Employer profile management.
  4. Application submissions.
  5. Opportunity matching.
  6. Communication and notifications.
  7. Reporting on learner registration, applications and placements.
  8. Platform administration and support.
  9. Legal and compliance purposes.

The platform owner must process personal information in accordance with applicable South African privacy laws, including POPIA. POPIA introduces conditions for lawful processing of personal information and sets minimum requirements for processing by public and private bodies.

A separate Privacy Policy / POPIA Notice should be published on the platform and accepted by users during registration.

15. Consent to Share Learner Information

By applying for an opportunity, a learner consents to the platform making the learner’s application information and supporting documents available to the relevant employer or administrator for placement-related purposes.

Learners understand that employers may use their information to assess suitability for opportunities, contact them, shortlist them or manage placement processes.

Employers must use learner information only for legitimate recruitment, placement or programme support purposes.

16. Communication and Notifications

The platform may send users email notifications, system notices or administrative communication relating to:

  1. Account registration.
  2. Password resets.
  3. Applications.
  4. Opportunity updates.
  5. Employer responses.
  6. Announcements.
  7. Platform maintenance.
  8. Support matters.

Users are responsible for keeping their contact details up to date.

17. Intellectual Property

All platform design, software, graphics, databases, documents, templates, content and branding belong to the platform owner or its licensors, unless otherwise stated.

Users may not copy, reproduce, modify, distribute, sell, reverse-engineer or exploit any part of the platform without written permission.

User-submitted content remains the responsibility of the user who submitted it, but the user grants the platform owner the right to store, display, process and use such content for the purpose of operating the platform.

18. Availability and Technical Support

The platform owner and/or technical service provider will take reasonable steps to keep the platform available, secure and functional.

However, the platform may be unavailable from time to time due to:

  1. Maintenance.
  2. Hosting interruptions.
  3. Internet service disruptions.
  4. Security updates.
  5. Technical faults.
  6. Events beyond reasonable control.

The platform owner does not guarantee uninterrupted or error-free access.

19. Third-Party Links and Services

The platform may contain links to third-party websites, services, documents or resources.

The platform owner is not responsible for third-party content, security, availability, privacy practices or services.

Users access third-party websites at their own risk.

20. Disclaimer

The platform is provided as a placement support tool.

The platform owner does not warrant that:

  1. All user information is accurate.
  2. All opportunities are suitable for every learner.
  3. Employers will respond to applications.
  4. Learners will be placed or employed.
  5. The platform will be free from errors or interruptions.
  6. The platform will meet every user’s individual expectations.

Users use the platform at their own risk.

21. Limitation of Liability

To the maximum extent permitted by law, the platform owner, administrators, service providers, employees, contractors and representatives will not be liable for any direct, indirect, incidental, special or consequential loss arising from:

  1. Use or inability to use the platform.
  2. Incorrect user information.
  3. Employer conduct.
  4. Learner conduct.
  5. Failed applications.
  6. Missed opportunities.
  7. Technical interruptions.
  8. Data loss caused by factors beyond reasonable control.
  9. Third-party websites or services.

Nothing in these Terms excludes liability that cannot legally be excluded under South African law.

22. Account Suspension and Termination

The platform owner may suspend, restrict or terminate user access if:

  1. A user breaches these Terms.
  2. Information provided is false or misleading.
  3. A user misuses the platform.
  4. There is suspected fraud or unlawful activity.
  5. Continued access may compromise the platform or other users.
  6. The account is inactive for an extended period.
  7. The platform is discontinued.

Users may request account closure by contacting the platform administrator.

23. Data Retention

The platform may retain user information and application records for as long as reasonably necessary for:

  1. Placement support.
  2. Reporting.
  3. Programme administration.
  4. Audit purposes.
  5. Legal compliance.
  6. Dispute resolution.
  7. Platform security.

24. Changes to the Platform

The platform owner may modify, improve, suspend or discontinue any part of the platform at any time.

This may include changes to features, content, access rights, registration processes, reporting tools or user workflows.

Where practical, users may be notified of material changes.

25. Changes to These Terms

The platform owner may update these Terms and Conditions from time to time.

The latest version will be published on the platform.

Continued use of the platform after changes are published will constitute acceptance of the updated Terms.

26. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any dispute arising from the use of the platform will be subject to the jurisdiction of the appropriate South African courts or dispute resolution forum.
